Judge Dismisses Drake's Lawsuit Regarding Kendrick Lamar's Not Like Us

A judge has thrown out Drake's defamation lawsuit targeting the music corporation concerning Kendrick Lamar’s song the diss record.

Judge Jeannette Vargas decided that the rapper’s song lyrics, which claimed the artist and his associates of being "pedophiles", were "protected opinion" and could not be deemed defamatory.

Drake filed the lawsuit in early this year, claiming Universal Music Group, the record label behind both artists, of defamatory conduct by permitting the song to be published and marketed, saying it spread a "untrue and harmful story".

Drake's representative said he intended to appeal the decision. UMG said it was pleased with the outcome and was eager to continuing its collaboration with the musician.

Background of the Hip-Hop Feud

Not Like Us, which was first dropped in spring 2024, was widely seen as the final strike in an ongoing battle between the rival rappers.

It has emerged as the biggest hit of Lamar's musical journey, having won five Grammys and being one of the most-talked about moments of his Super Bowl half-time show in February.

In a 38-page order, Judge Vargas called the row between the artists "the most infamous rap battle in the history of rap music".

"Both rappers’ seven-track rap battle was a 'verbal conflict' that was the focus of substantial media scrutiny and digital debate," the judge wrote.

"Although the accusation that Drake is a pedophile is undoubtedly a grave allegation, the wider backdrop of a intense musical rivalry, with provocative remarks and offensive accusations hurled by each artist, would not incline the average audience to believe that 'the track' conveys truthful statements about the claimant."

She additionally observed that, in an earlier song, Drake had "dared his rival to make the paedophilia accusations" that appeared in the diss record.

On the track Taylor Made Freestyle, the rapper used the AI-generated voice of the late rapper to suggest strategies on how to prevail in the feud.

"Suggest he has a preference for minors, consider that a tip," the track proposed.

"It is in this context in which such lyrics as 'Hey Drake, I’ve heard you prefer them young' must be assessed," stated the court.

"The similarity in the wording suggests strongly that this line is a clear reference to Drake's lyrics in the prior song."

'A Slap in the Face to Creatives'

The musician, whose real name is Aubrey Graham, did not name Lamar in the lawsuit.

His legal team alleged UMG of launching "an effort to generate a popular song" out of a release that made the "false factual allegation that the artist is a criminal paedophile, and to suggest that the audience should resort to vigilante justice in response".

Ruling against the plaintiff, Judge Vargas said listeners would not expect "truthful accounts" from a musical attack "replete with profanity, insults, threats of violence, and figurative and hyperbolic language."

She pointed out that Drake himself had engaged in similar language, referencing a line in which the star "strongly" suggested that "Lamar is a spouse beater", and a separate instance where Drake "claims that he 'heard' that one of Lamar's children may not be biologically his."

Regarding Lamar's song, Judge Vargas said: "Although seemingly factual claims may assume the character of subjective views... when made in open discourse, intense arguments, or other circumstances in which an listener may anticipate the use of epithets, passionate language or exaggeration."

Reacting to the rejection, a label representative said: "From the outset, this case was an affront to every creative and their creative expression and never should have seen the light of day."

"We're pleased with the court's dismissal and look forward to resuming our partnership successfully promoting Drake's music and supporting his career," the spokesperson continued.

A spokesperson for the musician said the rapper intended to appeal the decision, "and we look forward to the Court of Appeals examining it".

Lamar has not yet comment on the legal matter.
